Declaration of compliance for food contact materials

Food is in contact with packaging materials for long periods of time. Therefore, there are strict legal requirements to ensure the safety of packaged food. For example, a ‘Declaration of Compliance’ must be available for every packaging material.

As a Quality Assurance consultant at Mérieux Nutrisciences, specialising in the safety of food contact materials, Jacco van Son visits both food producers and producers of plastic packaging materials.

As a result, he sees how both deal with the legal Declaration of Compliance, which allows a food producer to assess whether the material is suitable for its product. In his opinion, there are still gains to be made in assessing this declaration correctly. In this article, he explains how.

The producer of packaging material

Let me start with the producer of the packaging material. The latter puts the packaging material on the market and must ensure that it has the correct Declaration of Compliance. The packaging material must comply with legislation. To prepare and substantiate the declaration, it gathers information. This comes from suppliers of the raw materials, migration tests, legislation, literature studies and HACCP studies. It must be ascertained which substances the packaging material consists of, whether – and if so which – auxiliary substances are used in production. It must also be determined which substances (may) be created when processing the material; these are called ‘non-intentionally added substances’. The information is recorded as ‘supporting documents’ and is managed by the producer of the packaging material this supporting documentation is used to prepare the declaration. The information can also be requested there.

In addition, intended use must be taken into account. The law specifies the requirements migration tests must meet. This depends on the foodstuff, the contact surface, the storage temperature and the

storage time. Which type of products and which conditions the packaging material is suitable for can be found in the Declaration of Compliance. The manufacturer must provide this declaration to its customer, in this case the food producer.

The food producer

In my experience, food producers do not always pay sufficient attention to assessing the Declaration of Compliance. It is best to carry out the assessment already during product development. It involves questions such as: What type of product will you pack? What are the storage times and temperatures? Will the product be prepared in the packaging and, if so, how? Is unintended use possible?

Points of attention

Some points to consider when assessing a Declaration of Compliance for plastic food contact materials:

The identity of the materials

It must be clear to which packaging material the Declaration of Compliance applies by stating the product name or article number, for example. Your

must be able to check whether the Declaration of Compliance applies to the material you have or will receive. A Declaration of Compliancecan only apply to multiple materials if they are similar in composition.

Confirmation that the material complies with applicable legislation

The declaration should include confirmation that the material complies with relevant legislation. Relevant legislation consists of both European and national legislation.

Do you use plastic with recycled materials? If so, there must be a record of compliance with legislation for these materials.

Adequate information on restricted substances in food

The Declaration of Compliance must include the identity of substances with a specific migration limit. It must also confirm that the substances with a specific migration limit do not migrate above this limit as long as the material is used according to the included conditions.

The specifications for the use of the material

The Declaration of Compliance should include the foodstuffs for which the material is suitable and the conditions under which the material can be used. These should correspond to the intended use by the food producer and consumer.

Note: the above list does not include all requirements; there are many more! They are included in ‘Annex IV Regulation (EU) No 10/2011 on plastic materials and articles intended to come into contact with food’.

Advice

I advise food producers to look more closely at the potential contaminants that may migrate into the food from the packaging and/or label in order to better assess whether the Declaration of Compliance provides sufficient information to determine whether the material is actually suitable. Is the Declaration of Compliance insufficiently assessed and is a packaging material not suitable for the final product and/or conditions to be packaged used? Then there may be a food safety hazard due to migration chemical constituents.
